Ivanley Noisette: A Letter To Our Ancestors: Dear Fellow Citizens

Dear Fellow Citizens:

One hundred fifty years ago, President Abraham Lincoln issued the Emancipation Proclamation. As most serious Lincoln scholars agree, the crux of the former President's opposition to the cruel institution was its denial of a person's basic entitlement -- the fruits of his or her own labor, and the depravations of human dignity that resulted from this denial.

Labor injustice was indeed a preeminent challenge facing American society during the 1800s. As Ira Berlin observes in his insightful book, The Making of African America: The Four Great Migrations, the involuntary migration of "Angolans, Igbos, Kongos, Minas, Mandes, and others" between the seventeenth and nineteenth centuries, by the millions, to the shores of the Americas, transformed these men, women, and children "into Africans and, in time, African Americans." These forced departures were primarily motivated by the insatiable and manufactured demand for 'free' labor--the sweat equity needed to cultivate and grow tobacco, rice, cotton, and sugar. The legions of tortured souls were victims of the epoch's agricultural economy in the American South and the global economy at large, and subject to racial violence and a segregated caste system that found expression in the laws and institutions of the land. Through their toils on the antebellum plantations of the American South, bloodshed sacrifice during a Civil War, resistance to de facto re-enslavement after emancipation, domestic migrations in search of justice and opportunity, and subsequent struggles to assert their human dignity in the face of appalling violence and stubborn oppression, African Americans developed what William Edward Burghardt Du Bois, in his classic book, The Souls of Black Folk, referred to as "a veil...[a] double consciousness...an American, a Negro; two souls, two thoughts, two unreconciled strivings; two warring ideals in one dark body..." Generations of African Americans were not only denied the fruits of their own labors, but also -- during some of the darker periods of American history--the rights and privileges enshrined in the American constitutional framework and body of constitutive commitments.

The strategies used to reconcile this Du Boisian identity crisis have had both legal and moral rationales and they have produced considerable gains: removing the yolk of chattel slavery; courageously protecting communities from widespread racial violence; ending Jim Crow segregation; attaining equal civil rights guarantees; and securing greater socioeconomic opportunities. With each of these victories, African Americans and other groups that have suffered on the margins of society, have served as the conscience of the nation and deepened the notion of American democracy.

The work of towering figures such as: Frederick Douglass, WEB Du Bois, Anna Julia Cooper, Carter G. Woodson, John Hope Franklin, Cornell West, Melissa Harris-Perry, Michael Eric Dyson, and Henry Louis Gates Jr, have made indispensable contributions to American intellectual life. Innovations from the gifted minds of figures like: Benjamin Banneker, George Washington Carver, Granville Woods, Patricia Bath, Neil deGrasse Tyson, and Dr. Ben Carson, have enriched the lives of millions of people. The classic works of master storytellers and poets, including: Phillis Wheatley, Paul Laurence Dunbar, Frances Harper, Langston Hughes, James Baldwin, Ralph Ellison, Zora Neale Hurston, Maya Angelou, Alice Walker, Toni Morrison, and many others, adorn the shelves of libraries around the world, and will continue to enrich American literary tradition for generations to come. The tireless work of activists, advocates, jurists, statesmen, and stateswomen -- from Harriet Tubman and Sojourner Truth, to Blanche Kelso Bruce and Charles Hamilton Houston; Thurgood Marshall and Martin Luther King Jr., to Robert Carter and Harold Washington; Shirley Chisholm and Jesse Jackson, to Van Jones, Tavis Smiley, and, of course, President Barack Obama, has advanced justice and deepened democracy in America.

From the seeds of West African polyrhythms, African Americans have developed Gospel, the Blues, Jazz, Rock and Roll, Soul, Hip Hop, and more -- using the music of artists like: Scott Joplin, BB King, Duke Ellington, Thelonious Monk, Billie Holiday, Miles Davis, Nina Simone, James Brown, Stevie Wonder, Michael Jackson, Whitney Houston, A Tribe Called Quest, The Roots, Lauryn Hill, Mos Def, Erykah Badu, Robert Glasper, Jill Scott, Raphael Saadiq, Esperanza Spalding, and many others, to find inspiration and cope with the suffering of the day. In athletic pursuits, the likes of Jesse Owens, Arthur Ashe, Paul Robeson, Muhammad Ali, Florence Griffith-Joyner, Michael Jordan, the Williams sisters, Tiger Woods, Kobe Bryant, and Gabby Douglas are just a few of the top performers that have evolved the art of sports.

These extraordinary individuals distinguished themselves in their respective fields and the world has benefited enormously from their talents. The soul of America, however, is not solely nurtured by their achievements, but also by those of numerous ordinary citizens as well. The mothers, fathers, teachers, nurses, lawyers, cashiers, cooks, custodians, and librarians that keep our communities functioning constitute the true heroes and heroines of American history and it is through their unwavering struggle and sacrifice, and the love they exhibit for others on a daily basis, that our Union is perfected.

Lincoln's recognition that depriving an individual of the fruits of his labor was a grave injustice strikes at the heart of the concept of human dignity. The suffering endured by the "souls of Black folk" behind the figurative veil that Du Bois so eloquently captured in his classic work over a century ago, was a testament not only to the resilience of suffering people, but also to the importance of striving toward a well-harmonized, citizen-based notion of human dignity that applies to all people living in America.

Du Bois probably understood -- as the visions of the Founding Fathers implied -- that the African-American identity crisis of his era would be reconciled by allowing all people to share in the fruits of a concept of full citizenship firmly rooted in morality and full human dignity, and protected by the laws and institutions of the land. This is precisely why he advocated a solution commensurate with the scope of past injustices -- a full Human Rights strategy -- even before the dawn of the Civil Rights movement. Let us build on the hard-fought progress of previous generations and honor the legacy of the Emancipation Proclamation by advancing the human rights of all of our country's beloved citizens and the rights of all people around the world.

Sincerely,
Ivanley Noisette

2012 ? ?No, I don't regret anything? - Legal Insurrection

1. Bill, thank you for your efforts and contributions. (P.S. Per radiofreeca, a special thank-you to Mrs. Jacobson.)

2. Happy New Year to you and to all LIans. Best wishes that future elections go better than this one did.

3. I regret nothing. There?s the rub.

If you mean you do not regret your decisions based on the information available at the time, I don?t quibble.

However, a year ago the GOP aimed?arguably, it expected?to retake the White House and the Senate. It failed to do either, losing seats in both houses of Congress to the campaign of a failed President. This, in a Republican year. Continue business as usual and imagine what will happen when the lay of the land favors the Democrats.

So when the GOP or a subset thereof says something like We were completely right all along and still are, I throw up my hands. When this attitude (way too smugly, way too glibly, way too often) surfaces at LI, my temptation is to post something that could get me banned.

4. We regret nothing? Okay, no argument from me. The question is what we should have done?and should do?differently, knowing what we know now (and knowing what we should be figuring out).

Like or Dislike: Thumb up1?Thumb down0

Insurance Stocks Rallying Through the Storms | Breakout - Yahoo ...

With the most densely populated region in the country getting battered by 100-year storms on what feels like an annual basis, it would seem insurance companies of all sorts would make for dangerous investments. Not so according to technical analyst, Paul Desmond of Lowry Research.

Desmond notes that the strongest sectors of 2012 have been Consumer non-cyclicals and Financials. Of the latter the insurance companies, both property and life, are the strongest subset.

This outperformance begs a lot of questions, not least of being "how on earth could companies on the front lines of statistically improbable, if not impossible, natural disasters be rising at all, let alone faster than other sectors?"

For an answer you'll have to talk to someone other than Desmond. He's a technician and his is not to question why when he sees positive moves in stocks. "We don't know why people are buying as aggressively as they are, but they are sure buying aggressively," he states.

Desmond is quick to add that insurance stocks are hardly impervious to the market as a whole. Reminding us that we're in a very old bull market, he has a grim outlook for stocks as a whole, particularly after the end of the first quarter.

It may not look like it on the calender, but March certainly feels like it's years from now. Desmond thinks the tape could get ugly by the start of Spring "but for the next several months" he's looking for further gains in the insurance sector.

Most investors would be happy to take it.

Date Night: Molly's in Soulard Saint Louis

If you?re looking for a cozy yet hip locale to grab some food and drink with your main squeeze, Molly?s in Soulard, St. Louis is pretty great. It?s both a bar and?restaurant (aka the ?bistro?)?within 2 separate buildings and also includes an outdoor patio area. My husband and I took the opportunity, while visiting St. Louis, to leave the kids with Nana and enjoy a night out. Molly?s in Soulard features a creole style menu inspired by?Louisiana, but not quite as overly spicy?as true Cajun food (that makes me happy!).

I loved the decor. The walls are a rich, dark red paint and the furniture is an antique black with a tin ceiling in the bistro ? gorgeous! There are accents of handmade class and days gone by throughout the place. Red velvet booth benches, period style posters and images, old brick with hints of signage from previous venues still painted right on the brick along with various chalkboards and pretty handwriting add a touch of style. Even the lighting is gorgeous.

Molly?s also regularly hosts a variety of live entertainment ? you can check out the schedule on their event calendar.

The food was delicious. Not your typical steak and potatoes or burgers, yet they do have both. We tried some new flavors and some classics we both really love?

I enjoyed the entire meal.?I enjoyed the appetizer the most. It was full of yummy unexpected flavors and seemed to be cooked just perfectly. There was a creole type sauce combined with a smoked BBQ flavor along with perfectly cooked shrimp and really big fried green tomatoes. It was so good!?I started my meal with a ceasar salad while my husband had the soup. The french onion soup was rich and thick and delightful. It?s one of his favs and he thoroughly enjoyed it with the real french bread cut nice and thick and the cheese perfectly melted on top.

For our main courses, I had the eggplant parmesan and hubs had the jambalaya. While the eggplant?parmesan?was beautiful to look at and I loved the addition of cherry tomatoes in this classic dish, there?was a bit too much of it? so much cheese and sauce the eggplant was lost.?My husband really liked the jambalya. It was full of flavor, the rice was cooked perfectly and there was a nice array and quantity of meat with onions and a variety of peppers.?I don?t do spicy much, so just tasted a bite of crawfish ? yum! The servings aren?t too big, but big enough that we were stuffed before we even got to dessert. However, dessert is my fav, so we had to stay and try a bit. Although I loved the sauce, the beignets were on the tough chewy side? not the ?New Orleans? doughnut I had expected although I don?t think I?ve had a beignet before, so I had nothing to compare to. It was all tasty enough that not only would I go back, I?d try these same dishes again.

The Soulard neighborhood is pretty neat. It?s an older part of town, the streets are lined with old French style row houses that have been converted into townhomes and apartments. Over the past 10 years the area has slowly grown into a hip little community for the young professionals. You?ll find a variety of small restaurants and hangouts near Molly?s including the 1860 Game Room, right across the street.

We asked our server if there was a ?Molly? representing the namesake of the restaurant, and he said? nope. The place was named after the original owner?s dog. Way to go Molly!

Oil & Gasoline Markets End 2012 with Swollen Inventory Levels

By EconMatters

In analyzing the last EIA report of the year it is noteworthy that gasoline stocks really rose the last 5 weeks of the year. The takeaway isn`t so much that gasoline inventories rose 23 million barrels the last 5 weeks of the year, wow that is some build in inventories, but the fact that Oil inventories barely budged at all during the process.
Seasonal issues regarding tax selling in order to move as much oil through the system to avoid higher tax liabilities is primarily responsible for the higher run rates of refineries, and thus the build in gasoline inventories, but that should result in large drawdowns of oil as there is a push and pull between products and the base commodity oil. Yet we end the year slightly above the 370 million barrel mark in US oil inventories. This is actually very bearish for oil because with these gasoline builds refineries are not going to want to keep adding more gas to storage as part of the reason refiners have done so much better with their margins is by keeping low inventory levels in the products so you have what appears to be a tight market. Well, we no longer have a tight market in gasoline, so no need to draw as much crude to produce the end product. We should start to experience some rather substantial builds over the next couple of months in crude oil as refiners request less base commodity, and lower their run rates. The Rise in Domestic Production This occurrence really points to the rise in US domestic production as imports were fairly light during the last two months of the year, and we normally have substantial drawdowns with refinery run rates in the 90s, so something definitely worth paying attention to going forward into 2013. Another point on imports and domestic production is that there is a very noticeable trend on the charts; imports have trended down after July, which is what one would expect after the summer driving season is coming to an end, but domestic production starts accelerating at a sharp right angle from July towards year-end. So these are domestic projects that are strongly trending regardless of summer driving season demand, and unlike imports that are managed according to seasonal demand dynamics, i.e., ?Saudi Arabia pumps more or less depending upon the season, the domestic projects are just going full bore and on a production path to increase performance each and every month if possible. This is something new to the market because we no longer have managed supply, just as Iraq is maximizing production right now because they need the revenue, well these domestic projects are just revenue based machines, and not being managed based upon supply and demand of the end market.? I will provide two charts to illustrate this interesting phenomenon.

The Demand Picture

Another point to be made is what is happening with gasoline demand, down in the wholesale sector 2.8 percent year-on-year. With GDP being better than expected, and most believing that the economy is stronger than it was last year, this could be related to better fuel efficient vehicles on average in the US consumer fleet as the car sales were pretty good the last two years, and maybe higher prices changing driving behaviors on a more permanent basis.?

The demand chart for 2012 can be explained by the run-up and actual summer driving season, with the inevitable falloff towards the end of the year. However, many analysts have forecast that the US being a mature country is going to trend down on a longer term basis from a demand standpoint, with most of the growth coming from emerging markets, but the year over year comparison is something worth paying attention to for 2013.

?If we have a repeat deceleration in demand at the end of 2013 year comparisons then further analysis will be needed to identify potential additional reasons for slowing demand in an economy that is seemingly strengthening with a stronger housing and employment market.? Fundamentals versus Price It would be great if Wall Street actually invested and traded based upon the fundamentals, but the oil markets have long since diverged from trading upon the fundamentals, especially in the short term, and are more ripe with ?managing? price swings either through sophisticated algorithms, and ?creative? fund flows than any notion of the fundamentals. To put it non-euphemistically, basically the oil market has been rigged for years, like most markets to some extent, and is about as corrupt as it comes. All any bystander has to do is pull up a price ladder of bids and asks, known as a trading Dom, and watch all the large fake orders and other assorted order flow shenanigans used to manipulate price up and down the chart each day. However, over the long term, the markets cannot stray too far from the fundamentals, for eventually the fundamentals take precedent over the trading shenanigans, especially if there is a definable, sustained trend in the fundamentals, and it appears that we are entering a new age where the world is going to have a five year period of abundant supply. A New Era: Growing Economy with Lower Energy Prices In fact, more supply than demand, even with a robust economy, because part of the reason the world economy will be doing so well is all the global enterprises out there producing oil. It?s a good business with very high margins when compared to many other industries with the past decade of higher prices.
Consequently, even if the US economy really takes off in 2013 as some have forecasted, don`t look for demand to overtake supply in the equation. The domestic oil renaissance means that we could have a booming economy, and still have more supply than we can use each day. Thus it is actually possible to have an era with a great economy, and even lower oil prices due to the domestic oil boom.?
